Elsa Mora is of counsel to CARNELUTTI Law Firm, and a member of the firm’s Labour department.

She advices international and domestic clients on complex employment related issues, both providing assistance in litigation matters and corporate legal advice.

Since the beginning of her career, she has worked in leading international law firms in their labour departments, dealing with all the issues concerning the establishment, the development, the suspension and termination of the employment relationship, (incentive plans and remuneration structures, top managers appointments and terminations, the employment law aspects of corporate transactions, all the secondment-related aspects and relevant administrative obligations, etc.).

She has also acquired extensive experience in the design and implementation of governmental supplementary salary schemes, reorganization plans and collective dismissal procedures, and she actively takes part in the relevant trade unions’ consultations.

She acted in a number of cases involving transfers of undertakings, and she is also highly experienced in managing diversity and anti-discrimination related matters.

Elsa is author of several articles on labor law matters and speaks at professional conferences and training courses on employment related themes.

She is fluent in English, in addition to her native Italian.

Litigation: Acting for domestic and international clients in relation to a full range of employment disputes,concerning:

  • Individual dismissals of employees and executives;
  • Collective dismissals;
  • Demotion and mobbing;
  • Claims for different classification and duties;
  • Claims for overtime payments;
  • Assessment of the subordinated nature of the employment relationship;
  • Enforcement of non-competition agreement etc.

 

Corporate legal advice: Day-to-day employment advice for domestic and international clients, including:

  • European “acquired rights” rules related to transfer of business matters, including negotiation with Works Councils and Union;
  • Advising on business transactions, including restructuring;
  • Reduction in workforce, collective dismissal and individual terminations;
  • Planning social salary schemes, including negotiation with Works Councils and Unions;
  • Negotiating “social plans”;
  • Planning for complex employment issues related to mergers and/or acquisitions and coordinating due diligence;
  • Creating and reviewing Executives’ compensation schemes (STI. LTI, etc);
  • Managing executive dismissals, including the negotiation of severance terms;
  • Drafting, auditing and revising employee handbooks and policies;
  • Drafting employment, consulting and service agreements;
  • Drafting and enforcing noncompetition covenants;
  • Conducting investigations regarding workplace misconducts;
  • Managing diversity and discrimination matters.
